Terms of Service

Rules for using SolidFitTrack as a gym owner, trainer, or athlete—please read them carefully.

1. Acceptance of terms

By accessing or using SolidFitTrack (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

If you use the Service on behalf of a gym, company, or other organization, you represent that you have authority to bind that entity to these Terms, and “you” includes that entity.

We may update these Terms from time to time. The “Last effective” date at the top of this page will change when we do. Material changes may be communicated through the Service or by email where appropriate.

2. Description of the service

SolidFitTrack provides online tools for gyms, trainers, and trainees to manage workouts, track progress, run gym operations (such as memberships, check-ins, and finances where offered), and related features as described on our website and in the product.

The Service is provided on an “as available” basis. We may modify, suspend, or discontinue features with reasonable notice where practicable, or immediately where required for security, legal compliance, or operational reasons.

3. Accounts, roles & gym relationships

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account unless you notify us of unauthorized use.

The Service is structured around gyms (or similar organizations). Users may have roles such as owner, trainer, or trainee. Permissions depend on your role and the gym configuration.

Your relationship with a gym (membership, training agreement, fees, waivers, and health screening) is between you and that gym. SolidFitTrack is a software provider and is not a party to those agreements unless we state otherwise in a separate contract.

4. Acceptable use

You agree not to misuse the Service. Without limitation, you must not:

  • Violate applicable laws or third-party rights;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems (including probing, scanning, or bypassing security);
  • Upload malware, overload infrastructure, or interfere with other users;
  • Use the Service to harass, discriminate against, or endanger others;
  • Scrape, resell, or commercially exploit the Service except as expressly permitted;
  • Misrepresent your identity, role, or affiliation with a gym.

We may investigate violations and cooperate with law enforcement where required.

5. Your content & license to us

You retain rights to content you submit (such as profile information, workout logs, photos, or text) (“Your Content”). To operate the Service, you grant SolidFitTrack a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process Your Content solely to provide, secure, and improve the Service—and to enable gyms and trainers you are linked with to use the product as intended.

You represent that you have the rights needed to grant this license and that Your Content does not violate these Terms or applicable law.

6. Our intellectual property

SolidFitTrack and its licensors own the Service, including software, branding, logos, and documentation. Except for the limited rights to use the Service under these Terms, no rights are granted to you.

Do not copy, modify, distribute, sell, or reverse engineer the Service except where law forbids such a restriction.

7. Disclaimers

Not medical advice. SolidFitTrack is a software tool. It does not provide medical, nutritional, or professional health advice. Workouts, evaluations, and metrics shown in the app are informational. Always consult qualified professionals before starting or changing an exercise program.

Fitness activities involve risk. You and your gym are responsible for safe training practices, equipment, and supervision.

Service “as is.” To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, SolidFitTrack and its affiliates, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from your use of the Service.

To the fullest extent permitted by law, our aggregate liability for claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), if you have not paid fees.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

9. Indemnification

You will defend and indemnify SolidFitTrack and its affiliates against claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

10. Termination & suspension

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service (with notice where reasonable).

Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

11. Changes to terms, governing law & general

We may update these Terms; continued use after the effective date may constitute acceptance of the revised Terms where permitted by law.

These Terms are governed by the laws applicable to SolidFitTrack operating entity and your location, without regard to conflict-of-law rules, except where mandatory local consumer protections apply.

If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
